Recently, I wrote a blog post on some of the compensation-related clarifications that are included in the instructions for the 2009 Form 990. Following are some additional changes/clarifications in other areas: • Governance (Part 6): There is a clarification of how to answer the question “was a copy of the Form 990 provided to the Board prior to filing?” You can only answer yes to this question if a copy of the 990 was provided to each voting member, whether in paper form or by email. • Statement of Functional Expenses (Part 9): Line 14 on the Statement of Functional Expenses is for technology expenses. The instructions clarify that the expenses on this line should include hardware/software expenses, support/maintenance services, web site design expenses, security programs such as virus protection. This line should not include any salaries or depreciation

The recent rains — well before the usual rainy season — have had a marked and positive impact on the levelof our Chain of Lakes. According to Roger Griffiths of the Lake Region Lakes Management District (often called the Canal Commission) the level of the Chain is 129.70 (feet above sea level) and on March 19 that level was 129.24.
The 2008 Form 990 had substantial changes that we are all still getting used to. And now the new 2009 Form 990 is out with additional changes! Actually, many of these “changes” are clarifications, but these may be new to some of us. Here are some of those items relating specifically to the compensation section of the Form 990: • What if you have an Executive Director who is not paid by the Organization, but is instead paid by an unrelated company? What has to be included in the compensation section of the 990 in this case? You would not report the compensation if the Organization is paying a management company for those services. But if that’s not the case, and if that person’s compensation paid by the other company is in exchange for that person’s services to the filing Organization, then you must report that compensation in Part 7, Section A of the form. There is an exception to this… if the compensation is paid by a taxable organization and the individual is an employee of that company, you do not need to report the compensation in Part 7, Section A. (Note: You ARE required to report compensation paid by related organizations).

When I first started working with non-profits I decided I should get smart and attended a seminar hosted by the Alliance of Arizona Nonprofits entitled “Starting a Non-Profit.” I expected to spend a few hours learning about the various forms and other requirements. What I actually walked away with was a new-found appreciation for those who do start non-profits, who keep them going, and even more for those who are smart enough to walk away from the idea.
